Weslaco, TX (KRGV) — The Court of Criminal Appeals of Texas denied John Allen Rubio's motion to stop his execution.

On Oct. 28, Rubio's defense team filed a motion that accused prosecutors of using false testimony from forensic psychiatrist Michael Welner.

The filing says Welner told jurors Rubio was not taking antipsychotic medication and did not show signs of psychosis before trial.

In a response, prosecutors argued Rubio had already raised a similar claim that an appeals court dismissed in 2022.

Cameron County District Attorney Luis V. Saenz released the following statement about the denial:

"Once again, the courts have rejected John Allen Rubio’s attempt to delay accountability for the horrific murders of three innocent children. For more than two decades, this case has remained a painful reminder of one of the most heinous crimes our community has ever witnessed. These three babies were robbed of their lives before they ever had the opportunity to experience the world. No amount of time, no legal maneuvering, and no appeal will ever erase what he did. Our office will continue fighting to ensure that the sentence imposed by a jury is carried out in accordance with the law. Julissa, John, and Mary Jane deserve to be remembered, and we will never forget them. Justice has been delayed for far too long."

Rubio and his common-law wife, Angela Camacho, were convicted in the 2003 deaths of their three children, ages 3, 1 and 2 months. Investigators say Rubio and Camacho killed the children because they could not support them financially. Camacho is serving life in prison.

Since his arrest in 2003, Rubio has claimed the children were possessed by demons.

Rubio is scheduled to be executed on Nov. 12, 2026.
