A judge temporarily reversed the suspension of Rio Grande City’s police chief, court records show.

The order that was granted on Friday allows Noe Castillo to keep working while his lawsuit against the city plays out.

As previously reported, Castillo sued the city after he was suspended with pay on Nov. 13. Rio Grande City officials told Channel 5 News the suspension went into effect as the city investigates allegations of “negligent mismanagement” of the public utilities department that occurred while Castillo was serving as deputy city manager.

Castillo then sued the city, claiming city leaders violated the Texas Open Meetings Act by discussing his suspension during a city commissioners meeting when the item was not on the agenda.

According to the judge’s order, the city must comply with the Texas Open Meetings Act and give public notice of any discussions regarding Castillo’s employment.

A hearing regarding the lawsuit was set for Tuesday, Dec. 3.
