Contractor Fails to Deliver on Home Valley Woman Paid Months Ago

SAN BENITO – Rosie Martinez spent years as a nurse in the Rio Grande Valley. Now she spends her time teaching them to earn their certification.

"I'm also the instructor so I teach a lot of nurse’s aides," said Martinez.

These days, Martinez is learning a difficult lesson.

In late 2016, she paid RGV Affordable Homes, LLC thousands of dollars to build a house for son.

To this day, the intended location of the home in San Benito remains an empty lot.

"They asked for a down payment, so I gave them the down payment," said Martinez. "We were promised the frame home which was nice and we decided yes, this is what he may need."

The contract she signed with the company read the construction would be complete by February 24, 2017. Martinez tells CHANNEL 5 NEWS it didn't begin until March of this year.

"'Yes we're going to be doing your home,'" Martinez said she was told. "They came over to the land and they made a lot of holes there. They prepared the land to throw in the foundation."

Martinez said months went by with no more construction.

Eventually the company told her they would be unable to deliver the house to her lot where it was supposed to be finished, because her street was too narrow for the structure.

Martinez tells CHANNEL 5 NEWS she met with the owner of the business earlier this month to reach a potential solution.

"Seven to ten days you will have your deed back without a lien and your money back. And that passed too and I didn't get anything," said Martinez.

CHANNEL 5 NEWS discovered RGV Affordable Homes, LLC's corporate privileges were forfeited in the state of Texas on September 22.

"RGV Affordable Homes, LLC had its corporate privileges forfeited effective 9/22/17 as a resulting of failure to comply with Texas Tax Code Chapter 171," said Texas Comptroller of Public Accounts spokesman Chris Bryan.

We traveled to their listed location and found no signs of a housing business. We also visited the home of the listed business owner and received no answer.

On Wednesday, we made contact with the listed owner by phone. She declined an interview.

She told us RGV Affordable Homes, LLC's is now under the management of her father and is going out of business.

She also said they are working with their attorney to release the contract and give Martinez a refund within the next two weeks.

"We gave them $3,500 as a down payment and $2,500, or $2,600 for the attorney," said Martinez.

Martinez is holding out hope she will be reunited with her money.
